Chiara Muston is a dual qualified lawyer (Italy and England) specialising in employment law. She is highly experienced in advising clients on domestic and cross-border matters concerning all aspects of employment relationships and industrial relations, both contentious and transactional.

Chiara has extensive experience assisting senior executives and companies of all sizes negotiate and draft employment contracts and service agreements (including for businesses subject to the SMCR), incentive plans, consultancy agreements and employee handbooks and policies. She also has experience in managing and terminating employment relationships, dealing with complex discrimination procedures and long-term sickness absences, whistleblowing cases, as well as negotiating settlement agreements with senior managers and executive directors.

She regularly advises employers in the framework of collective and individual consultations and negotiations with employees and trade unions representatives, as required in situations such as transfer of undertaking and redundancies (individual and collective), at national and European level.

Chiara has particular expertise in advising companies in the leisure, hospitality, automotive, telecommunications and gig economy sectors. She has been involved in their setting up, management, expansion, re-organisation and winding up phases, as well as strategic business decisions, such as implementing the government's furlough scheme (CJRS) and planning the return to work of staff, addressing health and safety as well as data protection issues.

She regularly represents clients in court in relation to matters involving violation of post-termination restrictions, unfair and wrongful dismissals, recognition of employment status as well as claims of discrimination and victimisation.

  • Advised a company in the gambling sector in relation to the disciplinary procedure and subsequent dismissal for gross misconduct of its CEO.
  • Represented a distribution company in the food and beverage sector in a dispute against one of its former commercial agents for the breach of post termination non competition restrictions.
  • Successfully represented a company in the automotive sector in a claim for damages brought against a former employee who had committed fraud against the employer and was subsequently dismissed.
  • Advised a global corporation in the IT sector in the transfer of parts of its business in the framework of a re-organisation implemented at European level.
